    Your problem is that you have absolutely no proof of how many times you have or haven't worn them. The only fact is that they are 5 years old, so you'll never get a warranty pay out for that.

    He has, it will be the outside of the sole unit, if they've been worn that little then it will show there.

    Can't see any manufacturer taking them back after five years. Nothing to stop the OP chancing his arm (nothing ventured and all that) but if I was him I wouldn't hold much hope
